Welcome to Marksmen Marketplace. These Terms and Conditions (“Terms”) govern your access to and use of the Marksmen Marketplace website, mobile applications, and services (collectively, the “Platform”). By creating an account or using the Platform, you agree to be bound by these Terms.
1. Nature of the Platform
Marksmen Marketplace provides a digital venue where third-party sellers (“Vendors”) can list items for sale via fixed-price listings or auctions.
The Role of Marksmen Marketplace: We are a facilitator. We are not the seller of record, the auctioneer, or a party to the actual transaction between Buyers and Vendors.
No Warranty on Goods: We do not pre-screen every listing and have no control over the quality, safety, or legality of the items advertised.
2. User Accounts
Eligibility: You must be at least 18 years old to use this Platform.
Account Accuracy: You agree to provide accurate, current, and complete information during registration.
Security: You are responsible for maintaining the confidentiality of your password and account. You are liable for all activities that occur under your account.
3. Selling and Auctions
3.1 Vendor Obligations
Vendors must accurately describe items and disclose any defects. By listing an item, you represent that you have the legal right to sell it.
3.2 Auction Rules
Bidding: A bid is a legally binding contract. If you are the winning bidder at the end of an auction, you are obligated to complete the transaction.
No Bid Shielding/Shill Bidding: Users may not bid on their own items or coordinate with others to artificially increase an item’s price.
Reserve Prices: Some auctions may have a “Reserve Price.” If the bidding does not meet this price, the Vendor is not obligated to sell.
4. Fees and Payments
Marketplace Fees: Marksmen Marketplace may charge commissions, listing fees, or payment processing fees. These will be outlined in our [Fee Schedule].
Payment Processing: We use third-party payment processors. By using the Platform, you agree to their terms of service.
Taxes: Vendors are responsible for determining, collecting, and remitting any applicable sales tax or VAT.
5. Prohibited Items and Conduct
Users may not list or sell:
Illegal drugs or drug paraphernalia.
Counterfeit goods or items infringing on intellectual property.
Offensive, hate-speech related, or hazardous materials.
Any item prohibited by local, state, or federal law.
6. Returns, Refunds, and Disputes
Vendor Policies: Each Vendor sets their own return policy, which must be clearly stated in the listing.
Dispute Resolution: In the event of a dispute between a Buyer and Vendor, both parties agree to first attempt to resolve the issue through our internal dispute resolution tool. Marksmen Marketplace reserves the right, but not the obligation, to mediate.
7. Limitation of Liability
To the maximum extent permitted by law, Marksmen Marketplace shall not be liable for any indirect, incidental, or consequential damages arising out of:
Transactions between Buyers and Vendors.
The inaccuracy of any listing.
The inability to access the Platform due to technical maintenance or outages.
8. Intellectual Property
The Marksmen Marketplace name, logo, and software are the property of Marksmen Marketplace. Users grant us a non-exclusive, worldwide license to use, display, and reproduce any content (photos, descriptions) uploaded to the Platform for marketing and operational purposes.
9. Termination
We reserve the right to suspend or terminate any account that violates these Terms, engages in fraudulent activity, or harms the integrity of the marketplace.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Insert Your State/Country], without regard to its conflict of law provisions.
